Moving to a new home is often a stressful experience that requires careful planning, organisation, and inevitably, time. Whether you are a resident of Luxembourg or a cross-border worker, you may be wondering whether employment law provides any specific entitlement for this situation. The good news is that Luxembourg labour law offers protection in the form of special leave. Vaglio Déménagement, your local moving specialist with more than 15 years of experience, explains everything you need to know about moving leave in Luxembourg.

How Many Days of Leave Are Granted for a Move in Luxembourg?

Luxembourg labour law recognises a personal change of residence as a valid reason for special leave.

To allow employees to organise their move under the best possible conditions, the legislation establishes clear rules:

  • Employees are legally entitled to 2 days of special leave when moving home.

  • This entitlement may only be granted once during a three-year period with the same employer.

  • However, if the move is required for professional reasons (for example, a transfer requested by your employer), this three-year restriction does not apply and the leave remains fully due.

Conditions and Practical Arrangements

This special leave does not follow exactly the same rules as annual paid leave. The key points to remember are:

  • Available from day one: Unlike annual leave, which requires a three-month qualifying period, special leave for personal reasons is available from your first day of employment.

  • Must be taken at the time of the event: The leave must be used in connection with the move itself and cannot be postponed for personal convenience.

  • Legal postponement rule: If the moving date falls on a Sunday, a public holiday, a compensatory rest day, or a non-working weekday (such as Saturday for employees working Monday to Friday), the leave is automatically transferred to the next working day following the event.

  • Interruption of annual leave: If you are already on annual leave when the move takes place, your annual leave is suspended for the duration of the special leave and then resumes afterwards.

How Do You Request Moving Leave from Your Employer?

To benefit from this entitlement, you must formally request the leave from your employer. Provided the legal conditions are met, your employer cannot lawfully refuse the request.

After moving into your new home, you will need to register your arrival with your new municipality of residence. This process allows you to obtain a certificate of residence. This official document serves as proof for your Human Resources department and justifies the granting of your moving leave.
